03QuestionsGeneral information

Common questions about collections & evictions.

  • Can I evict a tenant who isn't paying rent?

Only with a court order. Changing the locks, removing belongings or cutting off water or electricity is unlawful, even when rent is unpaid. We follow the procedure the law requires so that the eviction order is granted and can be enforced.

  • How long does an eviction take?

It depends on whether the tenant opposes the application and on the court's roll. An unopposed eviction can take a few months; an opposed one takes longer. Starting with a properly drafted notice and lease cancellation avoids delays later.

  • How does a body corporate recover unpaid levies?

Usually with a letter of demand first, then summons and judgment if the levies remain unpaid. A judgment can be enforced by attaching the owner's assets, including, as a last resort, the unit itself.

  • What is a letter of demand?

It is a formal letter from an attorney setting out the amount owed and the deadline for payment, warning that legal action follows if it isn't paid. Many debts are settled at this stage, without going to court.

  • Can a debt become too old to claim?

Yes. Most ordinary debts prescribe after three years if they are not acknowledged or claimed through the courts. If a debt has been outstanding for a while, act before prescription runs.
