Common questions about notarial work.
What does a notary public do?
A notary is an admitted attorney who has passed an additional exam and is authorised to prepare and attest notarial deeds. These include antenuptial contracts, notarial bonds, long leases, servitudes and usufructs, as well as the authentication of documents.
How do I get a document authenticated for use overseas?
A notary certifies or attests the document, and in most cases it then needs an apostille from the High Court or the Department of International Relations and Cooperation. Requirements differ by country, so check what the receiving authority asks for. We can guide you through each step.
What is a usufruct?
A usufruct gives someone the right to use a property and enjoy its income, often for life, while ownership rests with someone else. It is commonly used in estate planning, for example to let a surviving spouse stay in the family home that the children inherit.
What is a notarial bond?
A notarial bond is security registered over movable property, such as equipment or stock, in favour of a creditor. It is prepared by a notary and registered at the Deeds Office.
What is a cession?
A cession transfers a right, such as a claim, a policy or a debt owed to you, from one person to another. Cessions are often used as security for a loan.
