03QuestionsGeneral information

Common questions about wills & estates.

  • What happens if I die without a will?

Your estate is divided according to the Intestate Succession Act, which sets out who inherits by law. That may not match your wishes, and it can complicate matters for a spouse, life partner or stepchildren. A will lets you decide.

  • What makes a will valid in South Africa?

A will must be in writing and signed by you on every page, in the presence of two competent witnesses who also sign. A witness, or the spouse of a witness, should not be a beneficiary. We draft and supervise the signing so the formalities are met.

  • How long does it take to wind up an estate?

Most estates take between six and twelve months to finalise, and complex estates can take longer. The process runs under the supervision of the Master of the High Court and includes advertising for creditors and lodging the final account.

  • What does an executor do?

The executor collects the deceased's assets, pays the debts and taxes, and distributes what remains to the heirs according to the will. You can nominate a family member, a professional or a firm such as ours.

  • When should I update my will?

Review your will after any major life change — marriage, divorce, the birth of a child, buying property or moving abroad. A divorce in particular can affect how an existing will is applied, so check it soon afterwards.
