Common questions about family law.
How long does a divorce take in South Africa?
An unopposed divorce, where both spouses agree on a settlement, can often be finalised within a few months. A contested divorce takes considerably longer, depending on the issues in dispute and the court's roll. We give you a realistic timeline at the first consultation.
What is the difference between an opposed and an unopposed divorce?
In an unopposed divorce the spouses agree on everything — assets, maintenance and the care of children — in a signed settlement agreement that the court makes an order. In an opposed divorce those issues are decided through litigation, which costs more and takes longer.
Can mediation help us avoid a court battle?
Often, yes. In mediation a neutral mediator helps both of you reach an agreement about children, maintenance and assets. Agreements reached this way can be made an order of court, and the process is usually faster, cheaper and less adversarial.
How is child maintenance worked out?
Maintenance is based on the child's reasonable needs and on what each parent can afford. Both parents have a duty to support their children. Where parents can't agree, the Maintenance Court decides.
How do I get a protection order?
You apply at the Magistrate's Court under the Domestic Violence Act. The court can grant an interim protection order quickly, often on the same day, and sets a return date for the final order. We can help you prepare the application and represent you at the hearing.
